My 17yr old son was just charged today (July 2, 2011) with consumption of an illegal substance (K2/Spice) for his use and subsequent transfer to the ER for his actions on Monday, June 27, 2011.
What my concerns are is that the House and Senate bills to make possession and use of this substance did not pass until June 29, 2011 to be sent to Gov. Kasich for his signature.
In addition, when he was charged today at the police station, his father nor I were present, nor were requested to be present by the police.
Can he be legally be charged for this? In my mind, I would think that if he was to be charged with anything, it would be for using a product against it's labeling (apparently the product carries a label that states "not for human consumption").Can my minor son be charged with this crime in Ohio?
k2 incense is is illegal.. there is a *federal* ban, however lawyers are creative.

As a minor i believe he has to have parent/ gaurdian present. Since it was not a law yet i would say he has a good case on his side and product lableing misuse is his best defense as well as explaing he made a huge mistake experimenting. I would get a lawyer but in the end his mistake could have earned you a life time of free lawn mowing.Can my minor son be charged with this crime in Ohio?

edt sorry ma'am sounded like you was just trying to get him off no matter what................honestly sort out a decent lawyer for him and some rehab..................think they really might make it stick otherwise............mine is in the military and has known this crap was illegal for some time regarding their laws.......I hope your boy gets his life sorted out real soon, remind him you are a dang long time being a grown up and having a record is NOT fun
